TERMS OF SERVICE (ToS) & NO-REFUND POLICY
1. Digital Content & No-Refund Policy (All Sales Final)
Gamespeed Scouting provides real-time and delayed digital access to proprietary basketball intelligence, tactical video analysis, and academic data.
Final Sale: Due to the immediate, full digital access granted upon account activation, all subscription purchases are strictly non-refundable.
No Partial Refunds: We do not offer pro-rated refunds, partial refunds, or chargebacks for unused subscription periods or early cancellations.
EU Right of Withdrawal Waiver: In accordance with Article 16(m) of the EU Consumer Rights Directive, by completing your purchase and logging into the subscriber portal, you explicitly consent to the immediate delivery of digital content and acknowledge that you lose your statutory 14-day right of withdrawal.
2. Account Sharing & Intellectual Property Restrictions
Single Institutional License: A subscription grants access exclusively to the named individual and athletic department/club specified at checkout.
Prohibition of Redistribution: Subscriber accounts, evaluation reports, tactical video clips, and database records may not be copied, redistributed, resold, published, or shared with third parties, unaffiliated coaches, or public media outlets.
Account Revocation: Gamespeed Scouting reserves the right to terminate any account found to be sharing login credentials or redistributing proprietary reports without refund.
3. Subscription Auto-Renewal & Cancellation
Subscriptions auto-renew annually on the anniversary of your signup date. You may cancel your auto-renewal at any time through your account portal at least 48 hours prior to the renewal date. Cancellation stops the next billing cycle; it does not trigger a refund for the current billing cycle.
4. Price Adjustments & Term Changes
Gamespeed Scouting reserves the right to modify subscription fees for any package upon renewal. Any price adjustment will not affect your current active subscription term. Subscribers will receive written notice via their registered institutional email at least 30 days prior to their annual renewal date detailing any fee modifications. Continued use of the service or failure to cancel auto-renewal after the 30-day notice period constitutes acceptance of the updated pricing structure.
GDPR & PRIVACY POLICY
1. Data Controller Identification
Gamespeed Scouting is operated as a registered single-member LLC (Game Speed Basketball LLC), operating within the European Union and the United States. For data subject inquiries regarding European prospects or subscribers, contact: moises@gsbball.com.
2. Information We Collect
We collect and process two categories of data:
Subscriber Data (B2B): Name, institutional email (.edu or official club domain), job title, institution name, and billing details (processed securely via Stripe; Gamespeed Scouting never stores raw credit card numbers).
Athlete & Prospect Data (B2C/Public Interest): Publicly observable athletic performance metrics, tactical video footage recorded at public or sanctioned athletic events, athletic height/weight, and verified academic transcript conversions (Certificado de Habilitações).
3. Lawful Basis for Processing Athlete Data (GDPR)
Under EU GDPR Article 6, prospect evaluation data is collected and processed under:
Legitimate Interests (Art. 6(1)(f)): Evaluating athletic performance for educational and athletic advancement opportunities.
Explicit Consent (Art. 6(1)(a)): Direct parent/guardian or athlete consent obtained prior to publishing private contact handles or detailed academic records.
4. Data Subject Rights (EU Citizens & Athletes)
Prospects, parents, and subscribers located in the EU hold the following rights under GDPR:
Right of Access & Rectification: Request a copy of evaluation data or correct inaccurate information.
Right to Erasure ("Right to be Forgotten"): Request the removal of personal profile data or contact handles from the portal.
Right to Object: Object to the processing of personal data for recruitment databases.

Rates are standardized, publicly posted, and based strictly on data delivery latency. Gamespeed Scouting is not a player agency, recruiting proxy, or representative of any subscribing institution or prospective student-athlete.
